Acceptance of Terms

By accessing and using the services provided by LucidHarbor B.V. ("Company," "we," "us," or "our"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

Services Description

LucidHarbor provides consumer finance services including but not limited to personal credit solutions, financial planning, and credit assessment services. All services are subject to eligibility criteria, regulatory requirements, and our internal policies.

User Obligations

By using our services, you agree to:

• Provide accurate, current, and complete information during the registration process
• Maintain the security of your account and promptly notify us of any unauthorised use
• Comply with all applicable laws and regulations
• Use our services only for lawful purposes
• Not engage in any fraudulent, abusive, or illegal activities
• Respect the intellectual property rights of LucidHarbor and third parties

Eligibility

Our services are available to individuals who are 18 years of age or older and have the legal capacity to enter into binding contracts. Services may be subject to additional eligibility criteria including creditworthiness assessments and regulatory requirements.

Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which forms part of these Terms of Service. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

Intellectual Property

The content, organisation, graphics, design, compilation, magnetic translation, digital conversion, and other matters related to the LucidHarbor website and services are protected under applicable copyrights, trademarks, and other proprietary rights. All rights, title, and interest in and to the LucidHarbor services remain with LucidHarbor and its licensors.

Financial Services Regulations

LucidHarbor operates under the supervision of relevant Dutch financial authorities and complies with applicable European Union regulations. Our services are subject to regulatory requirements including but not limited to consumer credit regulations, anti-money laundering laws, and data protection regulations.

Limitation of Liability

To the maximum extent permitted by law, LucidHarbor shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our services. Our total liability shall not exceed the amount of fees paid by you to LucidHarbor in the 12 months preceding the claim.

LucidHarbor provides its services on an "as is" and "as available" basis. We make no representations or warranties of any kind, express or implied, regarding the use or results of our services. We disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

Indemnification

You agree to indemnify, defend, and hold harmless LucidHarbor, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses arising from your use of our services or your violation of these Terms of Service.

Termination

Either party may terminate this agreement at any time with or without cause. LucidHarbor reserves the right to suspend or terminate your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms of Service. Upon termination, your right to use the services will cease immediately.

Modifications to Terms

LucidHarbor reserves the right to modify or replace these Terms of Service at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

Governing Law

These Terms of Service shall be interpreted and governed by the laws of the Netherlands, without regard to conflict of law provisions. Any legal action or proceeding arising under these terms will be brought exclusively in the competent courts of Rotterdam, Netherlands, and you hereby consent to personal jurisdiction and venue therein.

Dispute Resolution

In the event of any dispute arising out of or relating to these Terms of Service, the parties agree to first attempt to resolve the dispute through good faith negotiations. If such negotiations are unsuccessful, disputes shall be resolved through the competent courts of the Netherlands.

Severability

If any provision of these Terms of Service is held to be invalid or unenforceable by a court, the remaining provisions will remain in full force and effect. The invalid or unenforceable provision will be replaced by a valid and enforceable provision that comes closest to the intention of the original provision.
